A. 4: Alimony is not only based on the ability of one spouse to pay the alimony or support. Other factors need to be considered such as the need of the other spouse to receive alimony, the length of the marriage, and other factors such as the standard of living during the marriage, education and ability to obtain employment of the spouses, health and ability to work, contributions to the marriage, among others. A determination is made on each individual case and different types of alimony may be granted, such as rehabilitative, durational or permanent.  (The different alimony awards will be described in detail in following blogs).

In addition, an existence or non-existence of a pre-nuptial agreement must be considered and reviewed.
